Information We Collect

Information you give us. We collect information you choose to provide, such as:

• Contact details: name, email address, phone and mobile number, company, title and mailing address.
• Inquiry details: what you tell us when you ask about investing, our communities or working with us, including whether you believe you are an accredited investor.
• Land submissions: property location, size, ownership, pricing and related details you send through Submit a Site.
• Sign-ups: your email address and preferences when you subscribe to our newsletter or research updates.

Information collected automatically. When you use the Site, we and our service providers collect:

• Device information: IP address, browser type, operating system and general location based on IP address.
• Usage information: pages you visit, links you click, time on pages, the site that referred you, and whether you open our emails.

We collect this using cookies, pixels and similar technologies (see “Cookies and Analytics”).

How We Use Your Information

• To respond to your inquiries and provide what you request, such as newsletters and research.
• To evaluate investor interest and, for investors, to administer offerings and investments.
• To review land and site submissions.
• To send you news, research and information about Cavan and its offerings. You can opt out at any time.
• To operate, secure and improve the Site, including preventing spam and fraud.
• To comply with law and protect our legal rights.

Cookies and Analytics

We use cookies and similar tools from service providers, including:

• Google Analytics, to understand how visitors use the Site. You can opt out with Google’s browser add-on.
• HubSpot, to manage contacts, forms and email, and to track how visitors interact with the Site and our emails.
• Google reCAPTCHA, to protect our forms from spam. reCAPTCHA collects hardware and software information and sends it to Google. Its use is subject to the Google Privacy Policy and Terms of Service.

You can block or delete cookies in your browser settings. Some Site features may not work without them.

How We Share Your Information

We do not sell your personal information for money. We share it only as follows:

• Service providers that help us run the Site and our business, such as website hosting, form, email, CRM, analytics and investor portal providers. They may use your information only to provide services to us.
• Cavan affiliates and project entities, including the entities that sponsor and manage our communities and offerings.
• Professional advisors and partners such as accountants, attorneys, fund administrators, accredited investor verification services, placement agents and lenders, when needed for an offering or investment.
• Legal and safety reasons, to comply with law, legal process or regulators, or to protect the rights and safety of Cavan or others.
• Business transfers, in connection with a merger, sale or financing of all or part of our business.
• With your consent or at your direction.

Investors and the Investor Portal

If you register for the Cavan Investor Portal or invest with Cavan, we collect additional information, including identification documents, Social Security or tax ID numbers, bank account information for distributions, and documents verifying accredited investor status. We use it to verify your eligibility, administer your investment, make distributions, prepare tax forms and comply with law. The Portal is hosted by InvestNext, which processes this information as our service provider and under its own privacy policy. We share investor information only as needed for these purposes, as described in the Investor Portal Terms and your offering documents.

Residents and Leasing

Cavan does not accept rental applications through the Site. Leasing for each community is handled by its property manager (currently RPM Living) through community websites that have their own privacy policies. If you contact us through the Site about a community, we may forward your inquiry to that community’s property manager.

Your Choices and Rights

• Email: Use the unsubscribe link in any marketing email, or email us at scashman@cavancompanies.com. We will process requests within 10 business days. We may still send you messages about an investment you hold.
• Cookies: Adjust your browser settings or use the opt-out tools above.
• Access, correction and deletion: You may ask us to access, correct or delete personal information we hold about you by emailing pkingsley@cavancompanies.com. Depending on where you live, you may have additional rights under state law, and we will respond as that law requires. We may need to verify your identity, and we may keep information we are required to keep by law or for our investors’ records.

Data Retention

We keep personal information as long as needed for the purposes above. Investor records are kept as long as required by our offering documents, tax and securities laws, and our record-keeping obligations. Inquiry and marketing information is kept until you ask us to delete it or it is no longer needed.

Security

We use reasonable administrative, technical and physical safeguards, including encrypted connections, secure cloud providers and access limited to authorized personnel. No system is completely secure. We will notify you of a data breach as required by law. Cavan will never ask for your password, or change wire or distribution instructions, by email alone.

Children

The Site is not intended for anyone under 18, and we do not knowingly collect information from children.

Changes to This Policy

We may update this policy. The current version is always posted at cavancompanies.com/privacy-policy with its “Last updated” date. If we make material changes, we will post a notice on the Site.
